Article 3. Definitions

“Parties” means LS and/or the Customer.

“Order” means any purchase made by a Customer on the Site.

“Product” means any item offered for sale on the Site.

Article 4. Formation of the contract

4.1 Browsing the Site constitutes acceptance of these Terms.

4.2 Creating an account implies express acceptance of the Terms. As these Terms may be amended, the applicable conditions are those in force on the Site on the date the User places the Order. You will be asked to expressly accept these Terms in order to confirm the creation of your account by ticking the box “I have read and accept the Terms”, then by confirming your Order by ticking the box “I confirm my acceptance”. You acknowledge that this “double click” constitutes your acceptance of these Terms (see also Article 6, Registration).

4.3 The User declares: that they have the capacity to enter into this contract, i.e. that they are of legal age and not under guardianship; that they are not purchasing products offered on the Site in order to resell them.

The Site is considered a site open to the public and is not intended for use by children. Children accessing the Site must obtain the permission and assistance of a parent or guardian to use the Site. By identifying yourself or placing an order on the Site, you acknowledge that you are of legal age under the laws applicable in your country of residence or that you have obtained the permission of your legal representatives. By using the Site, you represent and warrant that (a) all information provided in the online forms is true and accurate; (b) you will maintain the accuracy of such information; (c) your use of the Site does not violate any law or regulation applicable in the country from which you access the Site.

Article 5. Changes to the Terms

We reserve the right, at any time and at our sole discretion, to change, modify, supplement or remove certain provisions of the Terms. It is your responsibility to consult these Terms regularly to be aware of any changes. We will inform you of changes to these Terms by posting them on the Site. In the event of significant changes, you will be informed by any means we consider appropriate (e.g. email or pop-up window).

Use of this Site after the publication of changes to the Terms constitutes acceptance of those changes. If you do not accept these Terms and/or their amendments, you must not use our Site and, where applicable, you must request the deactivation of your account. Each Order will be subject to the Terms then in force.

Article 6. Registration

In order to purchase a Product, you must first create your account on our Site, or identify yourself as a “guest” user.

You will then need to complete a form with your name, delivery and billing addresses, telephone number and email address. You undertake to provide correct and up-to-date information. The information required to create your account is marked with an asterisk (see Article 15 “Personal data and cookies” for details on how the Site processes your personal data).

When creating an account, you will also need to choose a username and password that will subsequently allow you to identify yourself and browse the Site.

Article 7. Security and confidentiality of usernames and passwords

Your username and password are strictly personal. You must not disclose them to third parties. It is your responsibility to keep your password and username confidential and to restrict access to this information. You agree to be personally liable for all activities carried out with your username and password.

If you believe that someone else is using your account, you undertake to notify LS immediately by sending an email to: contact@lesliesulman.com. You undertake not to use another member’s account, username or password.

Article 8. Deactivating your account

You may deactivate your account at any time by sending an email to contact@lesliesulman.com.

Within fifteen (15) days of receiving your deactivation request, LS will verify that the conditions for deactivation are met and will deactivate your account and/or contact you where appropriate.

Article 9. Compliance with the Terms

By using the Site, you agree to be legally bound by the Terms and to comply with them, in the same way as if you had signed a contract. If at any time you fail to comply with Articles 14 and 21 of these Terms, we reserve the right, where applicable, to automatically deactivate your user account and/or block your access to the Site (in whole or in part) with reasonable notice.

However, in the event of a serious breach of Article 4, 11.4, 11.7 or 11.8 of these Terms, unless otherwise provided, you acknowledge that we may immediately and without notice terminate your access to or use of the Site by deactivating or deleting your user account and the related information and files in your user account and/or prohibit any subsequent access to such information and/or files and to our Site. Furthermore, you acknowledge that we will not be liable to you or to third parties for any damage that may result from the termination or blocking of access to or use of our Site following a breach on your part of the above provisions.

Article 10. Ordering from LS

10.1 Date of formation and date of performance of contracts. Any sales contract is deemed concluded between the Parties on the date LS sends the Order confirmation email. Notwithstanding the foregoing, if LS has asked the Customer to provide proof of identity, the contract will only be deemed concluded upon receipt of the final Order confirmation email sent by LS. The sales contract is considered performed from the dispatch of the Product by LS by any means.

10.2 Contractual documents and evidence. LS will keep a copy of the Orders and invoices issued by LS on a reliable and durable electronic medium. These copies are faithful and durable copies within the meaning of Article 1348 of the French Civil Code.

10.3 Right of withdrawal. In accordance with legal provisions, you have a right of withdrawal of fourteen (14) calendar days from the date of receipt of your order.

All items must be returned new, in their original, intact packaging, together with any accessories, instructions and other documentation. Items returned incomplete, damaged, deteriorated, soiled or in any other condition that would reasonably suggest they have been used or worn will be neither refunded nor exchanged and will be returned to you.

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to the supply of goods made to the consumer’s specifications or clearly personalised. This includes, for example, items personalised with messages, made-to-measure belts or any made-to-order, personalised tote that was not in stock at the time of the order. These personalised items are neither exchangeable nor refundable. The cost of returning the item is borne exclusively by the customer.

To exercise your right of withdrawal on non-personalised items, you can use the online withdrawal feature available in your customer area, under “My orders”, via the “Exercise my right of withdrawal” button, accessible for 14 days from receipt of your order. You can also send an email to contact@lesliesulman.com or a registered letter with acknowledgement of receipt to: Leslie Sulman — Customer Care — 45 rue de Courcelles — 75008 Paris, France.

The refund will be made within fourteen (14) days of the date on which LS is informed of your decision to withdraw. LS reserves the right to defer the refund until the items have actually been recovered or until the customer has provided proof of shipment of the goods, whichever occurs first. The refund will cover the price of the returned item(s) and the initial delivery costs (at the standard delivery rate we offer). Pursuant to Article L.221-24 of the French Consumer Code, additional costs linked to the choice of a specific or express delivery method will not be refunded. The refund will be made via the payment method used for the order.

Furthermore, in the case of a gift, the right of withdrawal remains the exclusive benefit of the customer who made the purchase and may under no circumstances be exercised by the recipient of the gift.

10.4 Exchanges. LS wishes to offer its customers the possibility of exchanging delivered items under the conditions described below. The customer may, at their choice, within fourteen (14) days of the delivery date, proceed with a remote exchange. The customer may call Customer Care and (i) request a return slip for the item(s) they wish to exchange, or (ii) return the delivered items in their original packaging, complete (boxes, accessories, protections, labels, booklets, etc.) and accompanied by the return slip and a copy of the invoice, to the following address: Leslie Sulman — Returns — 45 rue de Courcelles — 75008 Paris, France. Any new delivery can only take place once LS has received the items returned by the customer.

Items returned incomplete, damaged, deteriorated, soiled or in any other condition that would reasonably suggest they have been used or worn will not be exchangeable and will be returned by post in the case of a remote exchange.

Made-to-measure items (bags with a personalised message and made-to-order items) cannot be exchanged.

In the event of an exchange of items, the initial sale will be cancelled. Payment for the new sale will be made by offsetting the amount of the previous sale, it being understood that any overpayment will be subject to a credit note for any price difference greater than €75, or a re-credit to the customer’s bank card or bank account, provided the customer contacts Customer Care, for any remote exchange.

In the case of a gift, the exchange option may be exercised by the recipient of the gift, it being understood that in the context of a remote exchange via LS Customer Care, no refund may be made to the gift recipient in the event of a price difference.

In the event of an exchange of items via Customer Care, the new sale will be subject to these Terms of Sale. As part of the commercial exchange policy offered under this article, LS reserves the right to refuse an exchange beyond two (2) successive requests. Furthermore, any delivery costs paid by the customer will not be refunded.

Article 11. Customer reviews

LS invites you to share your shopping experience by leaving a review of the Products ordered on the Site. An email may be sent to you after receipt of your Order inviting you to leave a review.

In return for posting a review, a discount code usable on a future Order may be offered. This consideration is offered regardless of the content of the review: it is conditional neither on a minimum rating nor on a favourable review, and you remain free to express your opinion, positive, negative or neutral, on the Product concerned.

In accordance with the regulations applicable to online reviews, LS informs you visibly, on the page dedicated to customer reviews, when all or part of the reviews displayed were posted in return for a commercial benefit.

LS does not modify the content of reviews posted by Customers. LS nevertheless reserves the right not to publish or to remove a review whose content is manifestly abusive, defamatory, off-topic, contrary to public order or to these Terms, or whose authenticity cannot be established.

Article 12. Sale

12.1 Purchase of Products. You can purchase the products offered for sale in the areas of the Site.

12.2 Delivery times and costs. We deliver worldwide. Delivery costs vary according to the destination and the weight of the parcel. These delivery costs are indicated when you confirm your Order.

Article 12 bis. Legal warranties

Independently of any commercial warranty, all our Products benefit from the following legal warranties, which the Customer may invoke free of charge:

Legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code): the Customer has two (2) years from delivery of the goods to act. They may choose between repair or replacement of the goods, subject to the cost conditions provided for by law. They are exempt from proving the existence of the lack of conformity during the twenty-four (24) months following delivery of the goods. The legal warranty of conformity applies independently of any commercial warranty that may be granted.

Legal warranty against hidden defects (Articles 1641 et seq. of the French Civil Code): the Customer may decide to invoke the warranty against hidden defects in the item sold. In this case, they may choose between cancelling the sale or a reduction in the sale price, in accordance with Article 1644 of the French Civil Code. This action must be brought within two (2) years of discovery of the defect.

To invoke the legal warranties, the Customer may contact Customer Care at contact@lesliesulman.com. These warranties do not apply to defects resulting from normal wear and tear, misuse or lack of maintenance of the Product.

Article 13. Payment methods

LS offers its Customers the following payment methods:

Bank card (via Stripe): card payments are secured and processed by our payment provider Stripe Payments Europe, Ltd. The Customer’s bank details are transmitted in encrypted form and are never stored by LS. For any information, the Customer may consult: https://stripe.com.

PayPal: possibility of paying by bank card without opening a PayPal account. PayPal (Europe) S.à.r.l. et Cie, S.C.A. is a Luxembourg partnership limited by shares, registered with the Luxembourg Trade and Companies Register under number B118349, whose registered office is at 22-24, Boulevard Royal — L-2449 Luxembourg.
